Information We Collect

If you reside in the United States, there are two types of Information that may be collected through our Website: (1) “Personal Information” such as your name, e-mail address, physical address, phone number, credit card number, information about your computer and other information that may be used to directly identify you, and (2) “Usage Data” which is anonymous data about your use of the Website that is not linked to you personally.

You may enter the Website and browse its contents without submitting any Personal Information. Please note that we will only collect your credit card information if you choose to purchase our products online via our Website. If you do make such an online purchase, our payment processing partner will collect your payment information and process your payment. We do not store any credit card information or share it with anyone other than our payment processor.

Uses and Sharing of Information

We use your Personal Information that we collect directly to process your requests, fulfill your orders, authenticate website visits/usage, inform users of relevant products and specials through promotional e-mails, maintain and develop our Website, and communicate with you. You always will be given the opportunity to unsubscribe from further emails in any promotional messages we send you.

Except as described above, we will not disclose, rent, sell or share any Personal Information to unaffiliated third parties for marketing purposes.

We do contract with companies or individuals to provide certain services including email and hosting services, software development, credit card processing, shipping, data management, surveys and marketing, promotional services, etc. We call them our “Service Providers.” Such Service Providers include Ship Station, which provide shipping services for our Website. We may share both your Personal Information and Usage Data with Service Providers solely as appropriate for them to perform their functions. We do not share your credit card or other account information with third parties unless you authorize us to do so, or if it is necessary to fulfill our responsibilities including, but not limited to, delivering a product or service that you order.

International Data Transfers

If you are resident outside the United States, including in the EEA, we transfer Personal Data provided by you for processing in the United Stated, including Personal Information sent via-emails or when you make an order. Under the GDPR, we are considered a “controller” and a “co-processor” of the Personal Data of EEA Residents. By providing Personal Data to us for the purpose of using the Website, you consent to the processing of such data in the United States. The transfer of your Personal Data to the United States is necessary for the performance of a contract between you and us for your use of the Website.

Please note that the United States does not have data protection laws equivalent to those in the EEA and other jurisdictions.

Rights of EEA Residents

This section of the Privacy Policy is applicable to residents of the EEA, which consists of the member states of the European Union. This section also applies to residents of Switzerland and, in the event of its departures from the EU, residents of the United Kingdom. Under the GDPR, we are both the controller and a co-processor of the Personal Data of EEA Residents. Our purpose for collecting and processing Personal Data from EEA Residents is to provide them with the features and functionalities of our Website and information regarding our Website. The legal basis for collecting Personal Data is because it is necessary for performance of a contract between us to provide you with the Website and its related features and functionality. We also rely on your consent to receive information about our Website. Your Rights and Obligations

If you wish to review, delete and/or revise the Personal Information we have stored about you, please contact us with the specific request at privacy@michaelallenova.com; provided, however, that we reserve the right to retain an archive of such Personal Information for a commercially reasonable time to ensure that its deletion does not affect the  integrity of our data; and we further reserve the right to retain an anonymous version of such Information. If you are a resident of a jurisdictions outside of the United States, these qualifications may not apply to you.

If you use the Website,  you are responsible for maintaining the confidentiality of your account and for restricting access to your computer or devise, and you agree to accept responsibility for all activities that occur under your account.

Your Florida Privacy Rights

In 2020, new legislation was introduced for Florida Consumer Privacy Bill that would create limited online privacy rights and obligations in the state. If enacted, the law will become effective in July 2020. The legislation was amended to (1) allow consumers to review and correct their personal information; (2) create a right to opt-out of the “sale” of certain of a consumer’s personal information; and (3) Delineates specific notice requirements for online privacy statements.

Upon receipt of a request by a Florida customer, a business may be required to provide detailed information regarding how that business has shared that customer’s personal information with third parties for direct marketing purposes. However, this does not apply to businesses like ours that do not disclose Personal Information to third parties for direct marketing purposes without prior approval or give customers a free mechanism to opt out of having their personal information disclosed to third parties for their direct marketing purposes.
